Rental Agreement
The terms.

1. What you are renting
Oyen Digital rents you the storage device described in your order (the “Drive”) for the rental term you selected — 7, 30, or 90 days. The rental term starts on the day the Drive is delivered to the address you gave at checkout.
The Drive remains the property of Oyen Digital at all times. You may not sell, lease, pledge, or transfer it, and you may not remove, open, or modify its enclosure, firmware, or internal components.
2. What you pay, and what is only held
Two separate amounts touch your card, and they are not the same thing.
The rental fee is charged when you check out. It is the flat rate shown for the drive and term you picked.
The deposit is a pre-authorisation hold for the Drive’s full replacement value — an authorisation on your card, not a charge. Nothing is captured from it when the Drive comes back in good working condition; the hold is released. Depending on your bank, a released hold can take a few business days to disappear from your statement.
3. Card on file
By checking out you authorise Oyen Digital to keep your card on file and to charge it, without further authorisation, for: late fees under section 5; the cost of damage or loss under section 4; and the Drive’s replacement value if it is not returned.
We will email you an itemised statement for any charge beyond the rental fee before or at the time it is made.
4. Condition, damage, and loss
Return standard — “good working condition” means the Drive powers on, enumerates over its rated interface, passes a read/write verification, and is cosmetically intact apart from normal wear.
Normal wear is expected and never charged: light surface scuffs, minor scratches on the enclosure, and ordinary wear on the cable.
You are responsible for damage beyond normal wear, including but not limited to: bent, snapped, loosened, or otherwise damaged connectors and ports; drops, crushing, cracked or deformed enclosures, and other physical damage; liquid exposure of any kind; heat, fire, or electrical damage; and any damage caused by opening or modifying the Drive.
If the Drive comes back damaged we charge the lesser of the documented repair cost and the Drive’s replacement value, taken from the deposit hold. Anything left on the hold is released. If the Drive is lost, stolen, or destroyed, the full replacement value is charged.
5. Late returns
Your return is due on the last day of the rental term. If you need longer, extend before the term ends and you pay only the difference to the longer rate.
A Drive shipped back after the due date accrues a daily late fee equal to the Drive’s daily rate (its 7-day rate divided by seven), starting the day after the term ends.
Late fees are capped: they will never total more than the Drive’s replacement value.
A Drive that is more than 7 days past due and not in transit back to us is treated as unreturned. At that point the rental ends, accrued late fees stop, and the Drive’s full replacement value is charged to the card on file. If the Drive later arrives in good working condition, we refund the replacement charge less any late fees and repair costs already owed.
6. Returning the Drive
Every rental ships with a prepaid return label and reusable packaging. Put the Drive and its cable back in the original packaging, seal it, attach the label, and hand it to the carrier on or before your due date.
Keep the carrier’s drop-off receipt. A Drive is “returned” for the purposes of section 5 on the date the carrier scans it in, not the date it reaches us.
If your prepaid label is missing or unreadable, contact us before the due date and we will send another.
7. Your data
The Drive ships blank and you are responsible for the data you put on it. Oyen Digital is not a backup service for the contents of a rented Drive and is not liable for data loss.
Each 30- or 90-day rental includes 90 days of 1TB AvastorX Cloud free, whichever of those terms you choose; 7-day rentals do not qualify. Free periods from multiple qualifying rentals stack, up to a maximum of 3 years in total. When the free period ends, the AvastorX account continues on AvastorX’s paid plan at $8 per month for 1TB unless you cancel it. Archive your project there before the Drive ships back — that copy stays with you.
Every returned Drive is securely erased on intake. We cannot recover anything you leave on it, so archive first.
8. Shipping and territory
We currently ship to street addresses in the United States only. We do not ship to PO boxes or freight forwarders.
Risk of loss passes to you on delivery and returns to us when the carrier scans your return package in.
9. Cancellation
You may cancel for a full refund of the rental fee any time before the Drive ships. Once it has shipped, the rental fee is non-refundable and the term runs as booked; an early return does not shorten the fee, though it does release the deposit hold sooner.
